1. Acceptance of Terms
By accessing or using Humble ("the Service"), operated by HumbleOS, Inc., you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.
2. Description of Service
Humble is a platform that allows users to discover, plan, and share their festival experiences. Users can create schedules, review performances, follow other users, and engage with festival content.
3. User Eligibility
You must be at least 13 years old to use our Service. If you are between 13 and 18 years old, you may only use our Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
Users in the European Union must be at least 16 years old. By using our Service, you represent and warrant that you meet these age requirements.
4. User Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.
You are responsible for maintaining the confidentiality of your account and password. You agree to notify us immediately of any unauthorized use of your account.
5. Third-Party Services
Our Service integrates with third-party services, including Spotify, to enhance your experience. Your use of these third-party services is subject to their respective terms of service and privacy policies.
We are not responsible for the availability, content, or practices of third-party services. Any dealings between you and third parties are solely between you and such third parties.
6. User Content
Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). Content includes, without limitation, reviews and ratings of festivals, sets, and shows; discussion posts and replies on festival, set, and show pages; comments and replies on reviews; upvotes and downvotes; @username mentions; profile information; and any other material you submit to the Service. You are responsible for the Content you post, including its legality, reliability, and appropriateness.
By posting Content to the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service, including in aggregated or derived forms (for example, computed reply counts and discussion scores).
We may, but are not obligated to, moderate Content. We may remove, hide, soft-delete, pin, lock, or otherwise modify the visibility of any Content that we believe violates these Terms or our community guidelines, or that we determine, in our sole discretion, is harmful to users or to the Service. Soft-deleted Content may remain visible as a placeholder when replies exist, to preserve thread structure.
When you @mention another user, that user may be notified and your mention will be associated with your account. Repeated misuse of mentions, votes, or replies to harass or target other users is prohibited and may result in account suspension.
7. Data Processing and Privacy Rights
We process your personal data based on various legal grounds, including your consent, our legitimate interests, and legal obligations. You have rights regarding your personal data as outlined in our Privacy Policy.
If you are in the European Union, you have additional rights under GDPR, including the right to access, rectify, erase, restrict processing, and data portability. You may withdraw consent at any time.
8. Prohibited Uses
You may not use our Service:
- •For any unlawful purpose or to solicit others to perform unlawful acts
- •To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
- •To infringe upon or violate our intellectual property rights or the intellectual property rights of others
- •To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
- •To submit false or misleading information
- •To upload or transmit viruses or any other type of malicious code
- •To spam, phish, pharm, pretext, spider, crawl, or scrape
9. Privacy Policy
Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.
10. Subscriptions and Billing (Humble VIP)
Humble offers an optional paid subscription, "Humble VIP," that unlocks premium features (such as custom set status colors and custom wallpaper backgrounds, with additional features added over time). The features included in Humble VIP may change from time to time at our discretion.
10.1 Plans, Pricing, and Payment
Humble VIP is offered on a recurring monthly or yearly billing cycle. Pricing is displayed at the time of purchase and may differ between platforms. Depending on where you subscribe, payment is processed by:
- •Web — Stripe (payment processing) and RevenueCat (subscription state). Humble does not see or store full payment card details.
- •iOS (Apple App Store) — Apple's in-app purchase system. Charges are made to your Apple ID under Apple's Media Services Terms.
- •Android (Google Play) — Google Play Billing. Charges are made to your Google Play account under Google Play's Terms of Service.
By starting a subscription, you authorize the applicable payment processor to charge your selected payment method the then-current price, plus any applicable taxes, on the billing cycle you choose.
10.2 Automatic Renewal
Your Humble VIP subscription will automatically renew at the end of each billing period at the then-current price for your plan, until you cancel. Renewal charges will be made to the payment method on file unless you cancel before the renewal date. If your payment method fails, we may retry the charge or downgrade your subscription.
10.3 Cancellation
You may cancel your Humble VIP subscription at any time. Where you cancel depends on where you subscribed:
- •Web (Stripe): use the billing portal linked from the VIP page, or contact support@tryhumble.com.
- •iOS:manage in Settings > [your name] > Subscriptions on your Apple device.
- •Android:manage in Google Play > Profile > Payments & subscriptions > Subscriptions.
Cancellation takes effect at the end of the current paid billing period; you retain access to VIP features through that date. Cancelling stops future renewals; we do not pro-rate partial periods.
10.4 Refunds
Except where required by applicable law (including statutory consumer rights for users in the European Union, United Kingdom, and certain other jurisdictions), all subscription fees are non-refundable, and we do not provide refunds or credits for partial subscription periods or unused features. Refund requests for purchases made through the Apple App Store or Google Play are handled exclusively by Apple or Google under their respective refund policies — Humble cannot directly refund those charges. For Stripe (web) purchases, if you believe you were charged in error, contact support@tryhumble.com within 30 days of the charge.
10.5 Free Trials and Promotional Codes
We may offer promotional codes or free trials from time to time. Unless otherwise stated at the time of offer, free trials automatically convert to a paid subscription at the end of the trial period at the then-current price; cancel before the trial ends to avoid being charged. Promotional codes are non-transferable, may not be redeemed for cash, and may be subject to additional terms presented at redemption.
10.6 Price Changes
We may change subscription prices for future billing periods. Where required by law, we will give you advance notice of any price change before it takes effect. If you do not agree to the new price, you may cancel before the next renewal.
10.7 Taxes
Prices may be exclusive of applicable taxes (such as sales tax, VAT, or GST), which will be added at checkout where required.
10.8 Termination of VIP Access
If you breach these Terms or your subscription is terminated for non-payment, fraud, or chargeback, we may immediately revoke your VIP access without refund. We may also suspend or discontinue Humble VIP, in whole or in part, with reasonable notice; in that event, we will provide a pro-rated refund of any prepaid amounts for the unused remainder of your then-current billing period for purchases made directly through us. For App Store and Google Play purchases, refunds are subject to those platforms' policies.
11. Intellectual Property Rights
The Service and its original content, features and functionality are and will remain the exclusive property of HumbleOS, Inc. and its licensors. The Service is protected by copyright, trademark, and other laws.
12. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately.
13. Disclaimer
The information on this Service is provided on an "as is" basis. To the fullest extent permitted by law, HumbleOS, Inc. excludes all representations, warranties, conditions and terms. We do not guarantee the availability, accuracy, or reliability of the Service.
14. Limitation of Liability
In no event shall HumbleOS, Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
15. Governing Law
These Terms shall be interpreted and governed by the laws of the jurisdiction in which HumbleOS, Inc. is based, without regard to its conflict of law provisions.
16. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.
